At Visual Binary, we are on a mission to create fun, quick and easy experiences through our mobile products. Whilst we are on this mission, we aim to keep to the below simple rules.

Your data

Whenever possible, we will keep your data on your phone (the client) and avoid storing your data on our servers. Visual Binary is a local-first mobile app, where all possible activities are conducted locally on your device. You may still need a successful internet connection to enjoy the full benefits of Visual Binary.

Online Courses
We run & operate online interactive tutoring sessions. To access these sessions, you will need to secure your slot by choosing an available date & time, and providing valid details, including payment information. The sessions will operate via Zoom or Google Meet, and will involve human tutors providing lesson content, with interactive activities included throughout each session.

Online Course Introductory Offers

From time to time we may offer 'introductory offers' for booking a slot on an online course. For example, you may be able to secure your slot for a nominal £0 payment. Your purchase will automatically renew for the full amount of the course when the introductory offer period is over, or the slots are full for your session. You can cancel during your introductory offer by emailing team@jellytutor.com

Online Course Cancellations & Refunds

You are able to cancel your purchase any time by emailing team@jellytutor.com. Please note, if you have paid for the course, including any introductory offers, then you may be subject to a refund, only at the sole discretion of Visual Binary.

App Purchases

To enjoy some of the features and activities on the Jelly Product, you may be required to pay. This price may vary based on the desired duration of access to the app and related services. Currently, access our Product is billed annually. For example, if the subscription price is £19.99 per month, then you will be charged £239.99 (12 x £24.99) for one whole year access to the Product. If you have paid any introductory offer, this will be deducted before the billed amount is charged. You can cancel any time by emailing team@jellytutor.com.

App Introductory Offers

From time to time we may offer 'introductory offers' for accessing the app. For example, you may be able to receive access to all features in the Product for a select number of days, for a nominal £0 payment. Your purchase will automatically renew for the full amount of the Product when the introductory offer period is over. You can cancel during your introductory offer by emailing team@jellytutor.com

App Cancellations & Refunds

You are able to cancel your purchase any time by emailing team@jellytutor.com. Please note, if you have paid for the Product, including any introductory offers, and you have used the Product, then you may not be subject to a refund, at the sole discretion of Visual Binary. Use of the Product is defined as any customer who has successfully authenticated into the Product and accessed any feature inside.

App Store Purchases

If you pay for one of our apps through platforms such as Google Play or the App Store, your purchase will be subject to their underlying terms and conditions. For terms and conditions related to in-app subscriptions of Jelly Tutor, please refer to the standard Apple end user licence agreement (EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

Additional Terms

This Agreement shall be governed by the laws of England and Wales.

Visual Binary's failure to exercise or enforce any right or provision of these terms will not be deemed to be a waiver of such right or provision. If any provision is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court shall endeavour to give effect to the parties' intentions as reflected in the provision and the other provisions of these terms.

These terms will always remain in full force and effect.

Customers agree to indemnify and hold harmless Visual Binary against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of, or resulting from any breach or claimed breach of these terms, including claims brought by third parties.

Visual Binary reserves the right to change these terms and advise you to revisit our website, at jellytutor.com, periodically to ensure that you are aware of our current terms.

If a customer has dealt with us previously and our terms have changed in the mean time. All customers are bound by our latest terms.

Visual Binary complies with all requirements of the Data Protection Act. Your information will only be used if you have given us permission to do so. Any bank account or similar personal information you provide will be treated confidentially and will only be stored subject to high security methods.

All emails & messages between Visual Binary and its customers and potential customers may be recorded for security and training purposes. Any such recording may be retained subject to our Privacy Policy.
